Welcome to PlayGolfPlanet.com, the website and online service of Play Golf Planet, Inc. ("PlayGolfPlanet.com", "PGP", "we" or "us"). This page explains the terms by which you may use our online services, web site, and software provided on or in connection with PlayGolfPlanet.com (collectively the "Service"). By accessing or using the Service, you agree that you have read, understood, and agree to be bound by these Terms of Use (the "Agreement"), whether or not you are a registered user of our Service.

We reserve the right to amend this Agreement at any time by notifying you as provided in the “Modifications” section of this Agreement, provided that no notice shall be required or given for non-substantive changes to the Agreement. If we substantively amend this Agreement, we will give you at least seven (7) days notice before the changes take effect, during which period of time you may reject the changes by terminating your account. Your continued use of the Service after any such change takes effect constitutes your acceptance of the new Terms of Use. If you do not agree to any of these terms or any future Terms of Use, your only remedy shall be to not use or access (or continue to access) the Service. This Agreement applies to all visitors, users, and others who access the Service ("Users").

USE OF OUR SERVICE

1. Description of Service. PGP is a golfer to golf course marketplace that helps golfers connect and book tee times with participating golf courses.  Each golf course provides limited featured deals that are some of the most competitively priced rates available.  Golf Course's use PGP to sell the limited tee time deals only to their "Subscribing" customers as an exclusive membership.  A subscribing customer is a customer who follows or subscribes to their favorite courses through PGP.

2. Privacy Notice. A copy of the privacy notice that applies to the collection, use, disclosure and other processing of personal information is located at http://playgolfplanet.com/privacy.  You consent to any personal information we may obtain about you (either via the PGP site, email, or telephone) is being collected, stored and otherwise processed in accordance with the terms of the privacy notice.

3. PGP Accounts. You must create an account at PlayGolfPlanet.com in order to access the services and functionality that we may establish and maintain from time to time at in our sole discretion.  You are responsibility for the activity that occurs on your account.  You must keep you account password secure and must notify PlayGolfPlanet immediately of any breach or unauthorized use of your account.  You may never use another users account without permission.  PGP will not be liable for any losses caused by unauthorized use of your account.

The email address that you provide PGP during the signup process, you are acknowledging that it is in fact your personal email address.  By providing PGP with you email address, you consent to our using that email address to send you service related notices, including any notices required by law, in lieu of communication by postal mail.  We may also use your email address to send you messages, such as special offers, company updates and newsletters and new features added.   You may edit your email settings under My Account section of your account.

4. Membership Termination. You may cancel your account at anytime by emailing request to customer@playgolfplanet.com.  PGP has the right to cancel your membership and refuse future use of the PGP site, or any portion,  if you provide any information that PGP determines to be untrue, inaccurate or incomplete such as false information regarding user account and transactional information on reservations.

5. Reservation Processing. PGP, in its sole discretion, choose not to process or cancel your reservation in certain circumstances.  This may occur for example, if the the reservation request if no longer available or has been mis-priced, or in other circumstances PGP deems appropriate in its sole discretion.  PGP will either not charge you or refund the charges for reservations that we can not process or deliver.

6. Tee time availability. In rare cases, a tee time may be available when a customer places the order, but becomes unavailable prior to the check in date, due to unforeseen circumstances from the golf course.  If this should occur, please contact PGP to make alternative arrangements or to cancel your reservation.  In most cases PGP will contact you prior to checkin but will PGP.

7. Pricing information. PGP provides prices that have been pre-negotiated or the price reflected are a subject of the golf course posting the price directly.   The pre-negotiated prices and prices that are posted from the golf course directly, include the fees retained by PGP.   Pricing can vary depending on the course, availability and demand.  PGP's pricing model is dynamically priced, which means the prices can change daily depending on the courses preference.  The savings reflected on the price is determined by the regular price of the golf courses published rates.   If additional charges apply to your booking (including but not limited to the addition of an extra golfer, course environmental fees, or other fees charged by the course directly, PGP is not responsible for.  You will be responsible for paying these charges directly to the golf course.

8. Transactions. You agree that all transactions made by you on the site cannot be exchanged and are non-refundable.  Tee time policy can vary with each course.  You must accept the tee time policy with each golf course upon engaging in a transaction.  CANCELLATION. If you do not show up or cancel within the golf courses specified cancellation policy, you will be responsible for all charges for the total cost of the tee time and number of guests of the reservation.  If you cancel within the reservation window, then you will receive the deposit back minus any transaction fees that may have occurred.

9. Taxes and Fees. The sales or other taxes charged in connection with your booking depend on the location of the golf course and any rules governing those service providers.  Taxes are typically paid directly to the golf course at the time of checkin on the entire amount of the amount due.  In some cases you PGP will collect all or some of the transaction and in that case, the local taxes will be a applied to transaction.  You will be able to view the taxes including in a transaction before confirming the booking on the checkout page.

10. Payment. Reservations booked through PGP are either (1) Pre paid in full or (2) partial portion of the total will be collected.  For Pre Paid in full transactions, you will pay to total amount plus the applicable taxes up front.  For Partial payment reservations, you will pay a portion of the total up front, and the difference is paid directly with the golf course.  Both transaction types will be disclosed on each golf course before confirmation of payment.  You acknowledge and agree that the charges will be billed to your payment card, or that you will pay the charges using another payment method approved by PlayGolfPlanet.

11. Referral Credit. PGP may offer members the ability to earn credits toward future purchases on the PGP site.  PGP may also offer new users a promo code that users can redeem for credits.   By inviting your friends to become a member of PGP , you represent that you friend has consented to being contacted by PGP.   You may only earn credits via PGP channels.   You understand that referral credit is not transferable and may not be auctioned or sold.  Credits may also not be pooled with other members and expired based on the terms of the specific promo code or referral program.  You will receive a credit when you invite a certain number of friends or of one of your friends that you've referred buys a tee time within the specified booking window.  If you friend does not follow the direction in the invite email or social link, you may not receive the credit. You agree that having multiple PGP accounts is a violation of the Terms and Conditions and sending invites to alternate email address or accounts or otherwise attempting to circumvent PGP's referral program, results in the forfeit of your credits and the potential termination of your account.  PGP reserves the right to void credits if we suspect that the referrals were earned in an inappropriate manner.  PGP reserves the right to to terminate the referral / credit program at any time and any credits accrued may expire within 30 days.   Credits may only be applied to the total amount of the deposit that is collected by PGP at the time of a transaction.  Any credits that are left in the account can be applied for the next reservation.

12. Indemnity. You agree and defend, indemnify and hold PGP harmless and its subsidiaries, vendors, managers, employees, contractors, affiliated companies, officers, board of directors and directors, from and against any and all claims, damages, losses, costs, expenses (including but not limited to attorney's fees) and obligations arising from: (1) your use of services, (2) violation of any third party right, including, right of privacy or intellectual property rights. (3) violation of any term of this agreement, (4) any claim or damages that arise as a result of your user content submitted via your account, (5) or any other damages that may occur from the user of the PGP services.

13. Third party links. Some of the information and content may feature links to third parties, advertisers, services and other special offers that are not controlled by PGP.  PGP does not endorse or assume any responsibility for such third party sites.  If you access a third party website from the service, you do so at your own risk.  You agree that PGP shall not be responsible for loss or damages to your relations with such advertisers.

14. Copyright. The content on the Website, except all Submissions (defined below) is owned by or licensed to PlayGolfPlanet, subject to copyright and other intellectual property rights under the United States and international intellectual property laws and conventions. Content on the Website is provided for Your use only and may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any purpose without the prior written consent of the respective owners. You agree to not engage in the use, copying, or distribution of any of the content other than expressly permitted herein, including any use, copying, or distribution of Submissions of third parties obtained through the Website for any purpose whatsoever.

15. Trademarks. All trademarks and trade names used on the Website are trademarks and/or registered trademarks of ours or our affiliates or other third parties. The copying, redistribution, use or publication by you of any third party marks is strictly prohibited. The copying, redistribution, use or publication by you of any of our marks is strictly prohibited, without the express prior written consent of PlayGolfPlanet.

16. Modification of Terms of Service. You acknowledge and agree that PGP may modify, add or remove any portion of these terms or service at anytime.   You may not modify these terms of service under any circumstances.  The current version of these terms of service is available at http://playgolfplanet.com/terms.  It is your responsibility to check for any changes we make to the Terms of service.
